Terms of service

What you can expect from us, and what we need from you. Written to be read once, in plain language.

1. Who you are contracting with

Kicked S.R.L., trade register J2025037766002, tax code 51862990, VAT RO51862990, registered in Pitești, Argeș county, Romania ("Kicked", "we").

2. What we sell

Two kinds of thing. Recurring services — shared hosting, VPS, domain registration, DNS, email and SSL — ordered from the customer panel and billed per period. And project work — software, consulting, platform engineering, security, networking and hardware — agreed in a separate written proposal that sets its own scope, price and schedule. Where a proposal and these terms disagree, the proposal wins.

Some services are resold: domains are registered through our registrar partner, and part of our shared hosting runs on a reseller account. That does not change who you contract with — your contract is with us, and we answer for the service either way.

3. Prices, VAT and invoices

Prices on the website are net, in euro, VAT excluded. VAT is added at checkout under Romanian rules (currently 21%). Invoices are issued in Romanian lei, converted at the rate the customer panel applies on the day, because that is the currency our invoicing and banking run in.

  • A yearly term is billed as ten months on hosting, VPS and domains — two months free. Dedicated servers are billed for twelve.
  • Where a renewal price differs from a first-term price, the difference is shown next to the price before you order. We do not advertise a first-year price and renew silently at another.
  • A price change never applies to a period already paid for. If we change the price of a service you hold, you are told before the renewal that carries it.

4. Payment and what happens if it is late

Services are paid in advance for the chosen period. An unpaid invoice does not stop a service immediately: we send reminders, and a service is suspended only after the invoice is overdue and the reminders have gone unanswered. Suspension is reversible — data is kept for 30 days after suspension, and paying within that window restores the service.

After that window the service and its data may be deleted permanently. Take a backup before you let a service lapse.

5. Your right to withdraw (consumers)

If you order as a consumer rather than for a business, Romanian law (OUG 34/2014, implementing Directive 2011/83/EU) gives you 14 days to withdraw from a distance contract without giving a reason. Write to hello@kicked.ro; we refund within 14 days of being told, by the same means you paid.

Two honest exceptions the law allows. If you ask us to start a service immediately and it is fully performed within those 14 days, the right ends once it is performed. And a domain name cannot be returned: registration is paid to the registry the moment it is made and is irreversible — so a registered domain is excluded from withdrawal. We tell you this at the point of ordering, not afterwards.

6. Cancelling and leaving

You can cancel any recurring service from the customer panel, effective at the end of the period you have paid for. There is no minimum term and no cancellation fee.

Your code, your data and your configuration are yours. On request we provide a copy in a standard format and help you move to another provider, at no charge for the export itself. A domain can be transferred out at any time once the registry unlock period has passed; we do not hold transfer codes back.

7. Acceptable use

Do not use our services to break the law, send unsolicited bulk email, distribute malware, attack other systems, or host material you have no right to distribute. Do not consume so much shared capacity that other customers on the same machine suffer — if that happens we will tell you and help you move to a plan that fits, before taking anything away.

We suspend without notice only where the law requires it or where a live attack, an active malware distribution or a legal order leaves no time to ask. In every other case you hear from us first.

8. What we are responsible for

We run the services with reasonable professional care and fix what we break. Our liability for any claim is limited to the amount you paid us for the affected service in the twelve months before the claim. We are not liable for indirect or consequential loss — lost profit, lost business, lost data you held no backup of.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Consumer rights under Romanian law are not affected by anything in this document.

Backups: we take them and we verify them by restoring. They are a safety net, not a substitute for your own copy. Keep your own backup of anything you cannot afford to lose.

9. Changes to these terms

We may change these terms — to follow a change in law, or because a service changed. Material changes are announced by email at least 30 days before they take effect, and you may cancel without penalty before then. The date at the top of this page is the date of the current version.

10. Complaints and applicable law

Tell us first: hello@kicked.ro. We answer complaints within one working day and aim to resolve them within 30 days.

Consumers may also contact the Romanian consumer protection authority (ANPC, anpc.ro) or use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr. These terms are governed by Romanian law, and the courts of Argeș county have jurisdiction — which does not remove a consumer’s right to bring a case where they live.
