Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Kicked SRL ("Company", "we", "us", or "our"), registered under CUI 51862990, with registered office at Jud. Arges, Mun. Pitesti, Str. Patrascu Voda, Nr.3, Bl.d1, Sc.c, Ap.b4, Romania, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Services

Kicked SRL provides hosting, platform engineering, DevOps, site reliability engineering (SRE), network engineering, and consulting services. We operate autonomous system AS210622. Our services include but are not limited to:

  • Cloud and dedicated server hosting
  • Platform engineering and Kubernetes management
  • DevOps and CI/CD pipeline consulting
  • Site reliability engineering and monitoring
  • Network engineering and peering services
  • Technical consulting and infrastructure audits

3. Account Responsibilities

When you create an account or engage our services, you are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Send spam, phishing emails, or any form of unsolicited bulk communications
  • Distribute malware, viruses, or any harmful software
  • Launch denial-of-service (DoS/DDoS) attacks against any target
  • Host or distribute child exploitation material
  • Infringe on intellectual property rights of third parties
  • Mine cryptocurrency without prior written approval
  • Engage in network abuse, port scanning, or unauthorized access attempts
  • Resell services without written authorization

Violation of this policy may result in immediate suspension or termination of services without refund.

5. Service Level Agreement

We strive for 99.99% uptime across our infrastructure. Specific SLA terms, including compensation for downtime, are defined in individual service agreements. Scheduled maintenance windows are communicated at least 48 hours in advance and are excluded from SLA calculations.

6. Payment Terms

  • All prices are in EUR unless otherwise stated and exclude VAT where applicable
  • Invoices are issued at the beginning of each billing cycle
  • Payment is due within 14 days of invoice date unless otherwise agreed
  • Late payments may incur interest at the maximum rate permitted by Romanian law
  • Services may be suspended after 7 days of non-payment
  • Data may be deleted 30 days after service suspension due to non-payment

7. Data and Backups

While we maintain infrastructure-level redundancy, you are responsible for maintaining your own backups unless a managed backup service has been explicitly agreed upon. We are not liable for data loss resulting from:

  • Customer error or misconfiguration
  • Force majeure events
  • Third-party attacks despite reasonable mitigation efforts
  • Service termination due to policy violations

8. Intellectual Property

All content, tools, scripts, and documentation created by Kicked SRL remain our intellectual property unless explicitly transferred in writing. Custom work developed for clients is subject to the terms of the individual service agreement.

9. Limitation of Liability

To the maximum extent permitted by Romanian and EU law, Kicked SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate services with 30 days written notice. We may terminate or suspend services immediately if:

  • You violate these Terms or the Acceptable Use Policy
  • You fail to pay for services after the grace period
  • Required by law or regulatory authority

Upon termination, you have 14 days to retrieve your data before it is permanently deleted.

11. Governing Law

These Terms are governed by the laws of Romania. Any disputes shall be resolved in the competent courts of Pitesti, Arges County, Romania. For EU consumers, mandatory consumer protection laws of your country of residence may also apply.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or through our website at least 30 days before they take effect. Continued use of our services after changes constitute acceptance of the updated Terms.
